Paper
Sign nothing. A handshake is not a plan.
You want to look reasonable. Reasonable is how men give away a year before they have slept.
She is tired. You are wrecked. Someone says, let's just be adults about this. The kids' week gets sketched on a pad. You say you can stay at your brother's. She says you can take the Civic. You both say you do not want a fight. You shake on it because a handshake feels like character.
In the morning the handshake has a better memory than you do.
This is not legal advice. I do not know your state, your county, or your case. Hire a lawyer in your jurisdiction before you sign, move, or agree to anything lasting. What follows is a man telling you not to invent a life at the kitchen table at 1 a.m.
Why the first deal is dangerous
You are not negotiating. You are trying to make the feeling stop. Those are different jobs. The feeling wants a finish. A finish looks like yes, fine, whatever you want, I just need this to be over so I can breathe.
Over is not available tonight. What is available is a temporary sentence that other people will treat as the start of the story. Teachers will learn the new week. The friend who took you in will assume you live there now. A later conversation, and sometimes a later room with a lawyer in it, will begin from the thing you already said you were fine with.
I will not tell you that leaving the house means you lose the children. I will not tell you that a napkin schedule is a custody order. Those are the kinds of lines that get repeated until men think they are law. They are not law. They are fear. Fear still has a point: do not make a permanent shape while you cannot think.
What men agree to because they want to be decent
You can take the house. I will go. It sounds generous. It can also be a move you cannot easily undo, and the undoing, if it exists, is not something I can chart from here. Cool off for a night if you have to. Do not relocate your life because you want a medal for being easy.
We'll just split everything. Half sounds fair when you are ashamed and you want to prove you are not the villain. Fair is a word. Your retirement, the business, the debt, the house basis: those are not vibes. They are facts you do not have in front of you at midnight. A person who is allowed to advise you can put facts in front of you. A handshake cannot.
She can have the kids during the week. I will take weekends. You are trying to be a good father by disappearing from school nights. The children will learn a rhythm. You will learn a smaller life. If that is what a court later shapes, that is later. It is not a gift you throw across the table so she will look at you with less disgust.
I will pay the bills until we figure it out. Maybe you should, for a week, so the lights stay on. Maybe that sentence becomes the only plan anyone remembers. Figure it out is not a date. Put a time limit on anything you fund out of panic, and put it in writing after you have advice, not before.
What you say instead
I am not agreeing to anything yet. I need time and I need advice.
That is the whole speech. You will want to decorate it. Do not. Decoration is how you bargain. If she pushes, you repeat it. If a relative pushes, you repeat it. If your own guilt pushes, you write the sentence on a card and put the card in your pocket.
You can still be decent. Decent is: the kids eat. The kids get to school if that is your morning. Nobody gets a speech. Nobody gets a surprise move. You do not hide money like a man in a movie. You do not dump the joint account because you are scared, unless a lawyer has told you what to do with an account in your state. Scared is not a legal strategy.
Paper that is already in your hand
If someone served you, the document is not a conversation. It is a clock. I will not tell you how many days you have. That number is not mine to guess. A family law attorney in your jurisdiction will tell you what the paper actually is and what happens if you ignore it. Ignoring it because you want to look unbothered is how men wake up inside a default.
Bring the paper. Bring the handshake notes if you already made some. Tell the truth about what you said in the kitchen. A lawyer can work with a fact. A lawyer cannot work with the novel you told yourself about being the reasonable one.
The fear under the pen
You are afraid that if you do not agree tonight, you will look like the problem. Say that to the one man. Not to her. Looking like the problem is uncomfortable. Signing the decade to avoid the look is how you stay the problem until Christmas.
You are also afraid she will punish you for slowing down. She might be angry. Anger is allowed. Your job is not to manage her anger with a contract you do not understand. Your job is to keep the night from becoming a permanent map.
A handshake is not a plan. A plan is counsel, time, and a man who can still look at the page in the morning and recognize his own name. If the packet is still in your hand, that is a different night. Read She served papers tonight. Then run the First 24 Hours.
